Vichy Scalpconsult Pro Information Notice

Vichy Canada, part of L’Oréal Canada Inc. (collectively, “Vichy”), has instituted the following Information Notice related to any personal information that Vichy may collect, obtain, use, process, transfer, or store about You (“You”) resulting of Your use of Vichy Scalpconsult TM Pro ("Scalpconsult"). For further information about Vichy privacy related practices as they relate to this service or other personal information Vichy collects about You when You use our website or other Vichy services, please review Vichy's Privacy Policy.

Purpose

The purpose of the collection, storage, processing, and use of personal information for Scalpconsult is to provide You with a meaningful and efficient way to evaluate products for potential purchase and use. When You use Vichy’s Scalpconsult, Vichy collects and processes certain information, see “How It Works,” hereunder, to deliver a better beauty experience to You. Vichy may use information about You to (A) communicate with You about Vichy beauty products and services; (B) answer questions; (C) create better experiences; (D) provide tailored advertising, content, services, recommendations, and communications; (E) fulfill product purchases; (F) analyze use of Vichy products and services, without any associated personally identifying information of users, so as to improve effectiveness of Vichy Site, customer service, Scalpconsult (including improvement of the virtual Scalpconsult tool and underlying algorithm) and other offerings; (G) conduct research, including high-level analytics; (H) to comply with applicable laws or legal obligations; (I) for corporate governance, including mergers, acquisitions, divestitures, and other corporate restructurings; and (J) TO ENFORCE THE TERMS OF USE, which additionally govern and apply to Your use of Scalpconsult.

How It Works

You must grant a Specialist permission to take a series of pictures of Your hair and scalp using Scalpconsult tool (focusing on vertex, median and frontal parietal right and left). Scalpconsult is a hair and scalp assessment beauty tech device to scan and analyze hair and scalp health powered by artificial intelligence and a camera equipped with 3 lights technology.

Vichy will use an several algorithms to analyze the pictures to assess Your scalp and hair using multiple dimensions such as (A) scalp sebum condition, dandruff, hair fall risk, scalp microbiome indicator, and sensitive scalp, which is used to calculate a global scalp wellness index, and (B) hair density, hair diameter, hair diameter diversity, and dirty pore cleanliness, which is used to calculate a hair fall risk index score. This information, along with information You provide, are used to provide You with results and recommendations.

Based on results of the foregoing and the information You provide or elements observed by the Specialist (e.g., natural hair texture, hair type, condition of the hair), hair routine (e.g., washing frequency, hair accessories), hair concerns (e.g., dryness, damage, color fade), and scalp condition (e.g., oiliness, itchiness, dryness), You will be provided with Your results and recommended products. If You elect to receive in-salon treatment, there is an option for a second picture capture to show You before and after results of the treatment.

At the conclusion of the analysis, all consultation data may be sent to L’Oréal’s central cloud-based hub. Data is then deleted on the mobile app. If there is an issue with transmitting data from the mobile app to L’Oréal’s central cloud-based hub, then data is stored on the app for up to 5 days until a connection is established and data is successfully transmitted. Vichy, as well as its parent company, L’Oréal S.A., will use information as described in this Notice (i.e. images, attribute scores, survey answers, product recommendations, date and time stamp), including for analytics, research, production of statistics, to improve the Scalpconsult algorithms and to enhance products and services.

You may have the option to receive Your results at the end of the consultation. If You voluntarily provide Vichy with Your name and contact information (‘contact information’) to receive Your results, We will store all consultation data (excluding pictures) within Your profile at Vichy. If you provide Vichy with Your contact information, the information listed will be retained by Vichy in accordance with Vichy’s record retention and Privacy Policy and in accordance with applicable law.

Your Consent for Collection and Use of Personal Information about You

When You use Scalpconsult, You expressly and specifically consent that:

  • Vichy is collecting and storing the picture You provide or pictures taken of You by a Specialist and data obtained or created from the picture(s) taken of You by a Specialist, and picture(s) and consultation data collected or generated via the Scalpconsult is Processed by Vichy for the purposes set forth herein.
  • Vichy may share, disclose, or communicate information about You with any other affiliated company or brand (including its parent, L’Oréal S.A., and subsidiaries) as well as its service providers (such as the provider of cloud services used to provide You with the service). Vichy’s parent company, L’Oréal S.A., will use this information as described in this Notice, including for analytics, research, production of statistics, to improve the Scalpconsult algorithms and to enhance products and services.

When You consent to receive Your results at the end of the experience (if available), You also agree to the storage or retention of personal information about You, including information derived from the picture(s) taken of You by a Specialist. Specifically, You consent that Vichy will store personal information about You as described in our Privacy Policy, which will be retained subject to limitations in our Privacy Policy.

YOU UNDERSTAND THAT YOUR CONSENT TO THIS INFORMATION NOTICE IS A PREREQUISITE TO USE SCALPCONSULT.

Vichy Scalpconsult Information Notice coexists with, supplements, and does not supplant, obviate, replace, or otherwise supersede or suspend any other policy applicable to Your use of Vichy website and Scalpconsult, including the Terms of Use and Privacy Policy.

Vichy Scalpconsult Information Notice is subject to periodic updating, including to the extent that Vichy begins collecting personal information for any other purposes not specified herein. Vichy reserves the right to amend this policy at any time, which amendments will further apply to Your use of Scalpconsult subsequent to their enactment.

Data Retention

Vichy only briefly stores consultation data on the Ipad used to provide You with the Scalpconsult service. Once the information is returned to You and successfully transmitted to L’Oréal’s central cloud-based hub, consultation data generated from Your use of Scalpconsult are deleted from the iPad (generally after completion of the session but may be retained for up to five (5) days.

All consultation data (i.e., pictures, information observed about You by the Specialist, information you provided in response to the survey questions, the results from the analysis provided to You, and all recommendations provided to You) are stored in a central cloud hub to help Vichy and its affiliates (including its parent L’Oréal S.A., and subsidiaries) improve its products and its users’ experiences, including for analytics, research, production of statistics, to improve the Scalpconsult algorithms and to enhance products and services. This consultation data is stored as long as necessary for Vichy and its affiliates’ (including its parent, L’Oréal S.A. and subsidiaries) business purposes.

Data Storage

Vichy uses a reasonable standard of care to store, transmit, and protect from disclosure any data or information used in Scalpconsult consistent with the sensitivity of the data. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure.

Disclosure

Vichy may share, disclose, or communicate personal information with any other affiliated company or brand (including its parent and subsidiaries). For example, as disclosed in this Notice, Vichy shares information with its parent, L’Oréal S.A., for analytics, research, production of statistics, to improve the Scalpconsult algorithms and to enhance products and services. Vichy may also disclose personal information to Vichy service providers/data processors (including service providers who help Vichy provide You with services, such as cloud services providers).

Vichy may disclose information in connection with the sale or purchase of our assets, or in connection with any bankruptcy or reorganization proceeding. Vichy may also disclose personal information to comply with federal or provincial law, local law, municipal ordinance, or court order, including in connection with a validly issued warrant or subpoena (or other legal process); to verify or enforce our Terms of Use or other applicable policies, to respond to an emergency; or otherwise to protect the rights, property, safety, or security of third parties, visitors to our Sites, or the public.
